By inviting, installing, or continuing to use the Chronicler for Discord bot (the "Service"), you agree to these Terms of Service (the "Terms") and to our Privacy Policy (the "Privacy Policy"). If you do not agree, remove the bot immediately and cease all use.

BY USING VOICE CHANNELS WHERE CHRONICLER IS ACTIVE, ALL PARTICIPANTS EXPLICITLY CONSENT TO AUDIO RECORDING AND PROCESSING.
The Customer (server owner/administrator) is solely responsible for:
- Ensuring all Participants are clearly informed that audio may be recorded and processed; and
- Obtaining and maintaining all legally required notices, consents, and permissions (including any call recording, wiretapping, employment, or jurisdiction-specific requirements).
If you do not consent to recording, do not speak in voice channels where Chronicler is present or active.
1. Description of Service
Chronicler records audio in Discord voice channels (when prompted), transcribes that audio, and uses large-language-model (LLM) agents to generate transcripts, summaries, and other in-game content (collectively, "AI Output"). The Service relies on Discord's API and may integrate third-party providers (such as OpenAI, AWS, Google Cloud, or others) for hosting, speech-to-text, storage, and inference.
2. Eligibility & Age Requirement
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use the Service. By using the Service, you represent that you meet this requirement and are not barred from using Discord or similar services.
3. Definitions
- Server: A Discord "guild" where the Service is installed.
- Customer (or "you"): The individual or entity who invites or installs the Service on a Server (typically the owner or an administrator with Manage Server permissions).
- Participant: Any Discord user who speaks in, or otherwise interacts with, the Service within that Server.
- User Content: Any audio, text, or other material provided, recorded, or transmitted by the Customer or Participants.
- AI Output: Any content generated by the Service's machine learning models based on User Content or other inputs.
The Customer is responsible for the acts and omissions of all Participants under these Terms.
4. Acceptable Use & Customer Obligations
The Customer agrees not to:
- Violate any applicable law, regulation, or Discord policy.
- Upload, record, or transmit content they or Participants do not have the right to share.
- Use the Service to harass, threaten, defame, or unlawfully discriminate against others.
- Attempt to reverse-engineer, probe, or circumvent any technical limits, authentication, or security measures.
- Inject malicious prompts, code, or instructions intended to exploit or degrade LLM or system behavior.
- Interfere with, overload, or disrupt the Service or third-party networks.
- Deliberately craft prompts or inputs designed to generate harmful, illegal, defamatory, or inappropriate AI Output, or to circumvent content safety measures.
- Use the Service in any way that is not ethical, responsible, and lawful.
The Customer represents, warrants, and agrees that they are solely responsible for:
- Obtaining and maintaining all required consents and notices from Participants for recording and data processing.
- Ensuring their Server's use of the Service (including prompts, recordings, and AI Output) complies with applicable law and Discord's terms.
- Monitoring and being responsible for how Participants interact with AI features, including direct @mentions of the bot.
Suspension. We may suspend or terminate access for any Participant or entire Server at our sole discretion, including (without limitation) for breaches of these Terms, misuse of the Service, or conduct we reasonably deem harmful to the Service, users, or our reputation.
5. User Content & Licenses
5.1 Ownership
The Customer and/or applicable Participants retain ownership of their User Content.
5.2 Licence to Chronicler
The Customer grants (and represents they have the right to grant) to Chronicler and its subprocessors a non-exclusive, worldwide, royalty-free licence to:
- host, store, record, transcribe, process, analyse, and reproduce User Content; and
- generate AI Output and operate, maintain, secure, debug, and improve the Service.
We use User Content and derived data solely for providing and improving the Service, except where otherwise required by law.
5.3 Retention
- Raw audio is retained for up to 30 days from recording, then deleted.
- Transcripts, logs, and AI Output may be retained indefinitely for operational, debugging, and product-improvement purposes, unless deletion or anonymisation is requested (subject to technical and legal limitations).
6. Payments, Subscriptions & Refunds
- Purchases via Discord. Access to paid features (including premium tiers/SKUs) is purchased and managed through Discord's native monetization system. All pricing, billing periods, and renewal terms are displayed within Discord at the time of purchase.
- Billing & Renewals. Paid entitlements are billed by Discord (or its payment processors), not by Chronicler directly. Subscriptions may automatically renew until canceled in accordance with Discord's instructions.
- Payment Data. We do not collect or store your full payment card details used through Discord.
- Refunds. Unless required by applicable law, all refund requests related to purchases made via Discord must be directed to Discord and are governed by Discord's refund policies. We generally cannot override, manually process, or guarantee refunds for purchases handled by Discord.
- Entitlements. Access to paid features is tied to entitlements reported by Discord's API. If Discord suspends, revokes, or fails to report an entitlement (including for non-payment, chargeback, suspected fraud, or policy violations), we may suspend or limit access to corresponding features without separate notice from us.
- Promotional / Legacy Access. Any free, trial, Beta, or legacy access (including "Beta-scribe" or similar programs) is provided at our discretion and may be modified or revoked at any time.
7. AI-Generated Output
The Service uses machine learning models to generate AI Output based on User Content and other inputs. By using the Service, you acknowledge and agree that:
- AI Output may be inaccurate, incomplete, offensive, biased, or otherwise inappropriate. It may fabricate details or misinterpret context.
- AI Output is not reviewed, verified, or endorsed by the service. We do not guarantee that any AI Output is accurate, lawful, or suitable for any particular purpose.
- AI Output is provided solely as an aid for gameplay and entertainment. It is not legal, medical, financial, safety, or other professional advice.
- You remain solely responsible for reviewing AI Output before relying on it, sharing it, or incorporating it into your game, community, or other materials.
- AI Output may reflect or amplify the prompts, instructions, or content provided by the Customer or Participants. The Customer is responsible for how the Service is used in their Server.
- When using features that allow direct interaction with AI agents (including @chronicler mentions), you acknowledge that:
- Responses are generated in real-time without human review
- The AI may respond to or reflect the tone, content, or intent of your prompts
- You are solely responsible for your inputs and how you use any responses
- We do not monitor, filter, or pre-approve individual interactions
- Attempting to "jailbreak," manipulate, or circumvent content safety measures in AI features is prohibited and may result in immediate suspension
To the maximum extent permitted by law:
- Chronicler disclaims all responsibility and liability for AI Output, including any actions taken or content created, shared, or published in reliance on AI Output.
- All limitations of liability in Section 13 apply fully to AI Output.
We may store and reuse anonymised or aggregated AI Output and interaction data to operate, secure, and improve the Service.
8. Data & Privacy
Our collection, use, and retention of personal data are described in the Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our processing of data as described there.
9. GDPR and Data Protection Rights
Where applicable law (including GDPR or similar regimes) grants you specific rights regarding your personal data, you may have the right to:
- Access the personal data we hold about you;
- Request deletion of your personal data ("right to be forgotten");
- Request correction of inaccurate data;
- Request a copy of your data in a portable format.

10. Third-Party Services & Platform Dependencies
The Service depends on Discord and other third-party providers for critical functionality.
You acknowledge that:
- Chronicler is an independent application and is not owned, operated, or endorsed by Discord.
- Your use of Discord is governed by Discord's own terms and policies, which you must follow.
- Outages, policy changes, API limitations, or security incidents affecting Discord or other third parties may impact the Service.
- We are not liable for unavailability, data loss, delays, or other damages arising from or caused by third-party services or infrastructure.
Where third-party providers process User Content, they do so as our subprocessors under their own terms and in support of the Service.
11. Intellectual Property
All rights in and to the Service (including code, infrastructure, design, documentation, trademarks, and logos) are owned by Chronicler or its licensors.
Except for the limited rights expressly granted in these Terms:
- No licence or ownership is transferred to the Customer or Participants.
- You may not use our trademarks, branding, or name in a manner that implies endorsement without our prior written consent.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
To the maximum extent permitted by law, we:
- Disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components.
- Do not warrant that AI Output or transcripts will be accurate, complete, reliable, or suitable for any particular use.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CHRONICLER'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, OR AI OUTPUT SHALL NOT EXCEED USD $1 OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW, WHICHEVER IS GREATER.
- IN NO EVENT WILL CHRONICLER BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- ANY HARM ARISING FROM OR RELATED TO:
- AI OUTPUT;
- USER CONTENT;
- RECORDING OR TRANSMISSION OF COMMUNICATIONS;
- ACTIONS OR OMISSIONS OF DISCORD OR OTHER THIRD-PARTY PROVIDERS.
These limitations apply even if we have been advised of the possibility of such damages and even if any remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in those cases, these limitations apply only to the extent permitted by law.
14. Indemnification
The Customer agrees to defend, indemnify, and hold harmless Chronicler and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- The Customer's or Participants' use of the Service;
- User Content (including recording and processing of audio);
- AI Output used, shared, or relied upon in the Customer's Server;
- Any violation of these Terms or applicable law.
15. Service Changes & Availability
We may modify, suspend, or discontinue the Service (or any feature, plan, or tier) at any time, with or without notice, and without liability, provided that we comply with any non-waivable obligations under applicable law and platform rules.
16. Termination
- The Customer may stop using the Service at any time by removing the bot from the Server.
- We may suspend or terminate access immediately (or limit certain features) for any breach of these Terms, suspected abuse, security risk, or non-compliance with Discord or third-party requirements.
Upon termination:
- Rights granted to you under these Terms will immediately cease.
- Sections 5–16, 18–19 and any provisions that by their nature should survive, will continue to apply.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Iowa, USA, excluding its conflict-of-laws principles.
17.1 Informal Resolution
Before initiating formal proceedings, the parties must attempt in good faith to resolve any dispute related to the Service or these Terms for at least 30 days after written notice.
17.2 Mediation
If the dispute is not resolved informally, the parties shall participate in a one-day mediation in Des Moines, Iowa, administered by a mutually agreed mediator (in person or by remote means, as agreed).
17.3 Binding Arbitration
Except where prohibited by law or where you have mandatory, non-waivable consumer rights:
- Any unresolved dispute shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
- The arbitration will take place in Des Moines, Iowa (or remotely, if agreed).
- No class actions or class arbitrations are permitted.
If applicable law does not allow mandatory arbitration or class-action waivers for certain users, this Section applies only to the extent permitted by that law.
18. Changes to Terms
We may update these Terms from time to time.
- Material changes will be posted on our website or documentation at least 14 days before taking effect.
- Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must remove the bot and stop using the Service.
